Accelerate Property Fund and Azarert, the joint owners of Fourways Mall, have won a court battle against insurers as it seeks a R1-billion payout for Covid-19 business interruption.
At the heart of the dispute was whether infectious and contagious diseases (ICD) were part of the agreement following a complex series of events and iterations of the contract.
Defendants had also argued that the contract stood to be rectified and that necessary payments hadn't been made by the insured. Should any of these three issues be found in favour of the defendant, that would end the claim.
